Here are a few important things we think will make our relationship and your photo viewing or downloading experience at Event Pics Photography easier and more satisfying.
As used here or anywhere else on the Event Pics Photography website or other documents or correspondence, the singular including the plural, "EPP" means Event Pics Photography, "download or downloading" means and includes electronically moving or "saving" images from the EPP website to any computer or server other than the EPP server, "image" means a photographic image or photograph taken by EPP and/or which appears on or is downloaded from the EPP website, and "sponsor" or "event sponsor" means the person or entity which sponsors or hosts an event and/or hires EPP to take photographs for them.
By visiting and using the EPP website, including, but not limited to accessing, viewing or downloading any photographs on this website, you indicate that you understand and agree to the following terms and conditions.
The uploading or availability for viewing, downloading or printing of images taken by EPP is at the sole discretion of EPP. The fact that photos are taken is not a representation, committment or agreement by EPP that any image will be uploaded or will be available for viewing, downloading or printing.
While we may, at our option, re-touch some images prior to uploading them to our website, all photographs available on our website for viewing, downloading or printing are provided "as is". Because of the wide variety of kind, quality and settings of computer or other types of monitors, a photograph viewed on your monitor may appear different than the actual photograph as viewed on another monitor or printed.
Under no circumstances whatsoever shall EPP be responsible or liable to you or any other person for any damages for loss of enjoyment, disappointment and/or damages of any kind or nature, including, but not limited to direct, indirect, incidental, special or consequential damages on account of or caused by the failure, for any reason, of photographs to be available for viewing or downloading, or to be printable, or with regard to the content or depiction in any image found or viewed on, or downloaded from the EPP website.
EPP retains the ownership and copyright of all images, as well as all other rights to the images, of whatever nature, extent, duration and kind. EPP has granted the event sponsor or host a non-exclusive, unlimited and perpetual license to use or publish the images, for any and all legal purposes, including commercial uses. This license can not be transferred or assigned, nor may any image be sold by any person or entity, except EPP. The sponsor may give an image to others, but only without financial consideration, compensation or remuneration of any kind, and only for the personal, non-commercial use of the image by those to whom the image is given or thereafter transferred.
The sponsor acknowledges and understands that releases, including for commercial use, are ordinarily not obtained from persons or as to property pictured in the images, and the sponsor agrees to defend EPP against any claims, and to hold harmless and indemnify EPP for any damages, costs or fees, of whatever kind, nature or amount, including but not limited to loss of enjoyment, disappointment, direct, indirect, incidental, special or consequential damages or attorney's fees, which might be incurred by EPP in connection with the use, publication or giving of an image by the sponsor, or on account of or caused by the failure, for any reason, of photographs to be available for viewing or downloading, or to be printable, or with regard to the content or depiction in any image found or viewed on, or downloaded from the EPP website.
Except with specific written permission from EPP, you agree to use any image accessed, downloaded or printed from the EPP website only for display for your own personal enjoyment or to give as a gift, and you further agree not to use an image you access or download, print or are given by the sponsor or others for any commercial, unlawful or improper purpose.
Further, you agree to indemnify and hold EPP and the sponsor harmless for any and all damages, including but not limited to loss of enjoyment, disappointment, direct, indirect, incidental, special or consequential damages or attorney's fees, which might be incurred by you, by those for whom you are responsible or by others to whom you give an image, in whatever form, in connection with or caused by the taking, accessing, downloading, printing or use by you or those others.
By allowing your photograph, or the photograph of those for whom you are responsible to be taken by EPP, you grant EEP permission to take such photograph, and further grant to EPP, without consideration or payment of any kind, the unlimited and perpetual ownership and use, including any commercial use, of such photographs.
We try to link our website only to websites that share our values. Nevertheless, we cannot and do not independently verify the accuracy of information provided by them or on their websites. EPP is not responsible for the content or information collection policies of those linked sites, and we cannot and do not warrant its accuracy or completeness, or the quality of any services or products offered by the website owner or others connected with the linked website. If you visit another website which is linked from our website, you should review their privacy and other policies, and their service or product offerings, and inquire of the site owner as to any matters on which you may have questions or concerns.
All of these terms and conditions, information provided by EPP, promotions and availability of photographs are subject to change without notice, and, with or without prior notice, EPP reserves the right to modify any portion of these terms at any time as conditions warrant and at our sole discretion.
EPP is located in Las Vegas, Nevada. These terms and conditions, and the services and photos offered or provided by EPP are governed by and construed in accordance with the laws of the State of Louisiana, without giving effect to any principles of conflicts of law. All contracts or agreements between you and EPP are made in Las Vegas, Nevada, and you agree that any action at law or in equity arising out of or relating to your viewing the EPP website and/or accessing, downloading or printing photographs taken by EPP or from the EPP webiste, or these terms and conditions, shall be filed only in the state jusdicial district court located in East Baton Rouge Parish, Louisiana, and you hereby consent and submit to the personal jurisdiction of such court for the purposes of litigating any cause or action by or against you.
If any provision of these terms shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions. No oral representations, statements or agreements between you and EPP modifying these terms and conditions shall be valid, binding or enforceable.
Should our terms and conditions change in the future, the changes will appear on our website prior to the effective date of the change. To insure that you are aware of our current terms and conditions, we suggest that you visit our website and review these terms from time to time. Your continued use of our website or your accessing, viewing, downloading or printing of photographs by EPP subsequent to the revisions of these terms and conditions means you accept those changes.
